Conditions set for licensing exploitation of common construction materials

To be granted a license for the exploitation of Group IV minerals, organizations and individuals, must meet certain conditions.

The Government has issued Decree No. 193/2025/ND-CP, which provides detailed regulations for implementation of the Law on Geology and Minerals.

The decree outlines the conditions, sequence, and procedures for granting licenses to exploit common construction material minerals (Group IV minerals).

According to the regulation, Group IV minerals are defined as minerals used as common construction materials that are only suitable for purposes such as leveling, foundation backfill for projects, construction of irrigation works, and natural disaster prevention and control projects. These include: clay, hill soil, and other similar types of soil; soil mixed with rock, sand, pebbles, or gravel; and all types of sand (excluding sand and gravel from riverbeds, lakebeds, and sea areas, as well as silica white sand).

To be granted a license for the exploitation of Group IV minerals, organizations and individuals, as specified in Clause 1, Article 72 of the Law on Geology and Minerals, must meet certain conditions.

First, having obtained a decision on or approval of the investment policy for the mineral exploitation investment project from a competent State agency, for cases that require such a decision or approval under the law on investment;

Second, having obtained approval for the appraisal results of the environmental impact assessment report or an environmental license for the mineral exploitation investment project from a competent State management agency, for cases that require an environmental impact assessment or an environmental license under the law on environmental protection;

Third, complying with the mineral exploitation principles stipulated in Clause 2, Article 73 of the Law on Geology and Minerals;

Fourth, the area for which the exploitation license is requested must have results from a general survey and information assessment for Group IV minerals, or mineral exploration results, that have been confirmed, recognized, or approved by a competent authority.
